TERMS AND CONDITIONS
General
The parties to the agreement for services provided by BiketourinSpain are:
The client: the person requesting the services by submitting the booking form and the other persons included in the same booking.
BiketourinSpain: a Spanish travel agent, under license CICLM-13577-03
BiketourinSpain is owned by Raul Gonzalez Aguado as a self-employed person (‘Autónomo’ in Spanish) with number Y3819194N
By agreeing to these terms and conditions in the booking form, the client accepts all the BiketourinSpain conditions as specified hereunder.
Request, confirmation of reservations and payment
1/ The client requests one of the tours offered by submitting the ‘Get a quote – booking form’
2/ BiketourinSpain confirms that the tour can be arranged as requested and submits a quotation with the total price by e-mail.
3/ Upon written agreement by the client, a contract is established between the parties and BiketourinSpain issues an invoice for the tour.
4/ To complete the reservation, the client pays a deposit for 20% of the total price.
5/ The rest of the total amount is due 30 days before the start of the tour. If the booking takes place less than 30 days from the start date, the total amount is immediately due.
For both the deposit as the rest/total amount, the client receives an e-mail from STO Garant and pays through STO Garant’s online platform
STO Garant Guarantee Scheme
BiketourinSpain makes use of the guarantee scheme provided by STO Garant. You can check that this is the case by visiting STO Garant’s website and verifying that the organisation is listed as a participant (www.sto-garant.nl/en/members) You can find all information relating to STO Garant at www.sto-garant.nl/en.
Wheter STO Garant’s guarantee applies to a particular (travel)offer made by BiketourinSpain is clearly stated for that offer. The Guarantee Scheme specifies what the guarantee covers and which conditions apply. You can find the Guarantee Scheme on STO Garant’s website (www.sto-garant.nl/en/downloads)
If STO Garant’s guarantee applies to your booking, you do not pay the invoice sum to BiketourinSpain but instead into the escrow account belonging to Stichting Derdengelden Certo Escrow, a payment services provider registered with the national bank of The Netherlands (DNB) and the Dutch Authority for Financial Markets (AFM) This trust account holds your payment in reserve until the trip booked has come to an end. If services are not supplied (in full and/or on time) due to the financial insolvency of BiketourinSpain, STO Garant implements the guarantee. The Guarantee Scheme details how you can make a claim under the guarantee in such cases.
Cancellation
The client must submit a cancellation by e-mail. It will be effective upon receipt.
Cancellation charges:
If the cancellation takes place 90 days or more before the start of the tour: € 90 per booking
If it takes place between 89 and 30 days before the start: 20 % of the total amount
If it takes place between 29 and 15 days before the start: 40 % of the total amount
If it takes place between 14 and 2 days before the start: 60 % of the total amount
If it takes place one day before, the same day or no-show: the total amount
If due to unforeseen of exceptional circumstances, BiketourinSpain needs to cancel the booking. It will offer an alternative if possible and suitable to the client, or refund the payments received.
An alteration of the start date of a tour will be considered as a cancellation and new booking.
Assistance during the tour
Rental bicycle: the client is assumed to be able to mend or replace a punctured tire. He/she is provided with the material to do it. In case of breakdown of major malfunction of the bicycle, BiketourinSpain will endeavour to provide assistance as soon as possible, including transportation to the next accommodation and bicycle repair, at no cost to the client.
Weather: the client is assumed to ride any stage in the tour in case of rain, he/she is advised to bring proven effective clothing for cycling in rainy conditions (an advantage of luggage transport, it doesn’t matter bringing extra clothing just to be sure) If however, the client prefers not to ride in the rain, BiketourinSpain will arrange transport for client and bicycles to the next accommodation as soon as possible, but the cost thereof will be paid by the client.
Responsibility and insurance
BiketourinSpain cannot be held responsible and does not accept liability for an accident during the course of the tour; or for any injury or damage caused to the client or his/her luggage by third parties, whether they are contracted by BiketourinSpain or not.
The client is responsible for having the necessary health, fitness and cycling experience for the chosen tour, and for cycling cautiously and responsibly.
The client must have adequate insurance for the cycling holiday. Including all costs resulting from illness, accident and loss or damage to his or her property. Any medical costs and related because of an illness or accident during the cycling route are to be paid by the client either directly or through his/her insurance.
Jurisdiction
The travel arrangement and conditions as stated above are subject to Spanish law, in particular the Law 21/1995 of 6th July regarding Combined Holidays. They fall under the exclusive jurisdiction of the Spanish courts.
